02/01/2007 21/30 p.m.: Senate Passed Immigration Reform Bill Today

The Senate passed today Fair Minimum Wage Act, H.R. 2 today. The House passed this bill, H.R. 2 and the Senate debated the bill for the past several days. In the process, hundreds of amendments had been introduced on the Senate floor. The Senate floor then agreed to a lot of these amendments. One of these amendments which the Senate had agreed to and passed as Division B of the H.R. 2 is the Immigration Reform bill.
The immigration reform bill was introduced by Senator John Kerry and agreed to by the floor unanimously. The immigration reform bill that the Senate passed today covers a lot of the provisions which were part of the Comprehensive Immigration Reform Act of 2006 which the Senate passed last year and failed in the House.
We will analyze the bill and report it step by step for the next several days. Please stay tuned to this website.

snathan03-28 12:41 PMThis is the precise reason I am staying away from IV, people just dont show any civility in the forum discussions and starts name calling or shot down the people who ask questions.

If IV comes up with just one single GOAL of reducing the curent EB backlog for the restorgressed categories, people even from RoW countries will start participating in IV campaign and support IV's advocacy efforts in terms of their donations and volunteering for IV.

Reducing the current EB backlog will help everyone.

You guys are really great to find all these lame excuses not to participate.

Here's my situation. H-1B for self and H-4 for wife valid through Jan 2010. However our respective visas have expired in Dec 2006. So we'll need to get restamping next time we leave the country. We intend to travel to India this Summer from May through July. Ideally we would like to get the stamping done then during our stay in India. However there is a complication (isn't there ever) since my wife has an employer willing to sponsor her H-1B (starting in Oct 2008). I heard from the gurus here that this will be a COS from H-4 to H-1B and it is strongly recommended not to travel when a COS is pending. I think my options are as follows :

1. Get H-4 visa stamping in India in June while there. Assuming we do a premium processing for my wife's H-1B in April and travel to India after the decision is made (say by May), will there be any problems getting the H-4 visa stamping for my wife in India since we want to return in July before her H-1B starts in Oct?

2. The other option is to get a new H-4 stamping done before applying for the COS in April. This will be either done in Canada or Mexico I guess.

3. Another option is to straight away get the H-1b stamping for my wife in India instead of H-4 but that will cause her to wait in India through October which we would like to avoid.

Personally, we would like to do the first option, just get the H-4 restamping done in June and get back to US by July. But since she'll probably have an active H-1B starting in October, wondering if that will cause any issues when we go for the H-4 stamping.

sdrblr09-02 09:43 AMI beg to differ from your point of view that approvals are on PD. If you take a good look at the PDs of approved cases posted here, you will there are many post July 04 (mostly in Oct and Dec 04) and we all know there are many before that.

They are clearly going by ND. I have seen 1/2 case approved that had ND after 8/30/07



High number of approvals over the first few days were expected. Centers review/preadjudicate cases based on 'real' receive dates (which are close to notice dates), as physical files are sorted in that sequence. That is happening. Sept VB was available couple of weeks ago, which prepared them to issue formal approvals as soon as September starts. USCIS SOP describes that once cases are preadjudicated they are shelved (wating for visa) in sequence of PD's. Therefore, most approvals are preadjudicated cases.

Congratulations to All who got approved. Best wishes to those still counting. If you ND is not too far from published dates (i.e. it is sometime in Aug/Sep/Oct 07), and your PD is high, there is very high chance of you getting a good news soon.

But they have denied my request. i dont know what other financial hardship should I show them. Maybe I should declare bankruptcy and then send that over to USCIS to show that I really have financial hardship.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

same with my online status. we responsed to RFE in July 2009 and status showed RFE for the last one year. Recently (about a week back) a 'new' status field RFE review has been added and my application is in that status. Not sure if it means anything.

Hey GCN007, congratulations to you. We are very happy that folks with PD<01/08/05 are getting their long-awaited approvals - India or not, IV members or not. Clearly the wait is frustrating and the relief is boundless and we are happy for those who have found that relief.

But, are extreme metaphors really necessary? I don't think anyone here will be willing to chop off body parts for green cards! :) And I don't think it will give anyone receiving them as much relief/happiness.

Now, I know when filing is done on Jun 1 ( attorney said), we have to be in US.
Q1: Do we have to wait for receipt to be received by attorney and /or me?
Q2: From filing date, how long it will take to get the receipt? One day, two days , one week or two weeks or more.

My lawyer says that if you apply for EAD and AP at the same time then you need to remain in the country until these come through. As for 485, the only issue is FP notice. You will need to be in the country to do this. However, you can file to reschedule within 84 days of the FP notice if you are out of the country.

Can someone confirm the EAD/AP requirement of remaining in the country until they are approved?

I do not plan on using EAD/AP at this time. However, the lawyer says that if I travel on H1 and then 485 is approved while I am out of the country (HIGHLY unlikely....but still a possibility) then I will ONLY be able to travel back if I have AP. Can someone confirm this as well? So, I am forced to apply for EAD/AP. Otherwise I was planning on just filing 485 and traveling after FP.

I also met the staffs of three congressmen and attended the congressional reception as well. I'll cherish this memory forever, since not many will get this chance in their lifetime.

One of the memorable moment on a personal level is, I met two of my high school juniors after more than 15yrs. It was a great feeling.

It was you who presented a theory to justify that we should not go with any change in the spill over. I want to know why you dont want EB3I not to proceed with this measure. Is it because you believe it will take away numbers from EB2 or EB3I is doomed with plenty of cases and any amount will not make any changes. I believe its perhaps the earlier than the later. See, we all have our needs and we all want to look for ourselves first (including you and me). Its basic human nature. We all can generate obfuscatory facts to push our agenda. But at the end does it justify the means ?

I just presented a theory. Right or wrong is upto you to decide. I never said EB3 should not do anything for or against spillover. All I am saying is spill over either helps Eb3 from 2001 - 2003 (perhaps some 2004) or helps Eb2 post 2005 now for all other Eb3 folks the hope lies in PD recapture or upgrading to EB2 ( if spill over rules benefit EB2 only).

What about all those visa subs in July 07 with PD in 2002 - 2004 who are waiting less than EB2 2005 cases? Is it legal for them to get GC quicker the answer is YES. Is it ethical? I would leave it to the readers to decide.



willwin10-08 11:16 AMNo impact on BEC approvals on retrogression, BECAUSE THEY NEED TO GET I-140 to be approved, then only their case to be on the line for visa number. I agree with you. That's the reason I feel USCIS is just taking time to get their act together and move forward with PD.

I am very doubtful that DOS would open the gates completely next July (like this year) as they had very bad experience. But EB3 dates may move to early 2005 (March 2005 may be - before PERM was launched) and EB2 close to 2006.
